Privacy Act (1974)-Establishes how executive branch federal agencies gather, maintain, and disseminate PII.
Allows individuals to access their own PII, subject to exemptions and conditions to disclosure.
Requires publication of System of Records Notice.
Establishes the Fair Information Practice Principles for Federal agencies.
PII is information that can be used to distinguish or trace an individual’s identity, such as their name, Social Security number, biometric records, etc., alone, or when combined with other personal or identifying information which is linked or linkable to a specific individual
Protecting PII is the Law! Failure to follow these laws may result in civil or criminal penalties, or loss of employment.
In the United States, the Supreme Court has found that the Constitution implicitly grants a right to privacy against governmental intrusion.
Sensitive PII requires stricter handling guidelines because of the increased risk to an individual if the data are compromised.
